Terms and Conditions

1. General Terms

These Terms and Conditions govern the use of this website and the review, scheduling, and performance of landscaping services requested through it. By browsing the site, submitting an estimate request, or otherwise engaging Castro Landscaping about a project, the visitor or client acknowledges that these terms apply unless a separate signed written agreement states otherwise. Any estimate, proposal, or service summary provided through the site is intended to describe a specific project and is not a guarantee that the same pricing or availability will remain unchanged if the project facts later change.


2. Estimates and Scope

Estimates are prepared from the information available at the time of review, including the details submitted by the client, visible site conditions, approximate measurements, and any discussion that occurs before the work is scheduled. If the actual conditions differ from what was described or observed, the scope and price may be revised so the work can be completed properly. Any task, material, or service that falls outside the agreed scope should be treated as additional work and may require a separate estimate or written approval before it is performed.


3. Site Conditions and Access

The client is responsible for providing reasonable access to the property on the scheduled service day and for sharing any known conditions that could affect the work, including gates, pets, vehicles, irrigation components, buried lines, unstable grades, drainage issues, or other site features that should be handled with care. Castro Landscaping may delay or modify the work if access is blocked, if the property appears unsafe, or if hidden conditions are discovered that were not reasonably visible during the estimate process. Unseen obstacles, concealed damage, and previously undisclosed site limitations may require a change to the scope, price, or timeline.


4. Scheduling and Weather

Service dates are scheduled in consideration of weather, crew availability, travel distance, and the order of other projects already on the calendar. Landscaping work is often dependent on outdoor conditions, and rain, high winds, freezing temperatures, saturated soil, lightning, or other unsafe circumstances may require a delay or rescheduling. When weather or field conditions prevent safe or practical performance, the job may be moved to the next available opening without penalty to either party unless a separate written agreement states otherwise.


5. Changes and Additional Work

If the client requests a change after an estimate has been approved, the requested change may be handled through a revised estimate, a new proposal, or a written change order depending on the size and timing of the request. Additional labor, materials, disposal, deliveries, or return visits that are not included in the original scope may be billed separately. Where a substitute plant, material, or method must be used because of availability or site conditions, reasonable alternatives may be proposed for approval before the work continues.


6. Payment and Invoicing

Payment terms are determined by the estimate, invoice, or any signed agreement associated with the project. Unless a different due date is stated in writing, invoices are expected to be paid promptly upon receipt. Deposits, progress payments, and final balances may be required for certain projects, and work may be paused or rescheduled if an account becomes overdue. Returned payments, collection costs, and other reasonable recovery expenses may be charged where permitted by law and where they are stated in the applicable agreement or invoice.


7. Property Care and Limitations

Castro Landscaping will take reasonable care while working on the property, but the client understands that outdoor work involves existing conditions that may already be worn, unstable, hidden, or fragile. The company is not responsible for pre-existing damage, concealed defects, undocumented underground systems, or conditions that were not disclosed before work began. If a feature appears unsafe or likely to be damaged by ordinary performance of the requested work, the company may stop, protect the area, or request further instructions before continuing.


8. Cancellations and Delays

If a scheduled visit must be canceled or postponed because the client is unavailable, access is restricted, or conditions at the property prevent work from beginning, the appointment may be moved to the next available date. Repeated cancellations, late changes, or repeated failures to provide access can delay completion of the project and may result in a reasonable fee if such a fee is stated in the estimate or invoice. Castro Landscaping may also pause or discontinue service when payment is overdue, unsafe conditions remain unresolved, or continuing the work would not be practical.
